Terms & Conditions – Currency Key

1. Agreement Overview

These Terms & Conditions form a binding agreement between you and HFCEX Pty Ltd ("Currency Key"), trading as "Currency Key". They govern your use of our remittance and related services.

Please read these Terms & Conditions carefully. By using our Services, you confirm that you understand and accept these Terms & Conditions. If you do not agree, you must not use our Services.

2. Governing Law and Jurisdiction

This agreement is governed by the laws of Victoria, Australia. Both parties submit unconditionally to the jurisdiction of its courts.

3. Changes to Terms

Currency Key may update these Terms from time to time. The version in effect at the time of your transaction applies. We will notify you of any significant changes via our app or email.

4. Payment Terms

If you choose to pay via bank transfer or PayID, the payment must be made within 2 hours of initiating your transaction. Payments must come from an account in your name. Transactions funded by third-party accounts may be rejected.

Credit card payments may incur additional non-refundable processing fees. Currency Key is not responsible for any fees charged by your bank or card provider (e.g., overdraft or cash advance fees).

5. Exchange Rates and Fees

Exchange rate quotes are valid only at the time provided and subject to change due to market fluctuations. Rates are confirmed only once full payment is received. Different rates may apply based on transaction channels, customer segments, or promotions.

You agree to cover any costs incurred by Currency Key due to chargebacks or other processing issues caused by your transaction.

6. Cancellation and Refunds

If a cancellation request is approved, a $15 fee will be deducted from the original transaction amount. Refunds are made to the original payment method and may take 1–3 business days. Refunds due to Currency Key's error is processed in full without deduction.

7. Information and Documentation

You must provide accurate and current information about your identity, payment method, and receiver. Once submitted, transactions generally cannot be modified. You will have an opportunity to confirm details before finalizing.

We may verify your information electronically and request documents under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act).

8. AML/CTF Compliance

Currency Key is registered with AUSTRAC and complies with the AML/CTF Act. We may report certain transactions to AUSTRAC without notifying you. We may request details such as source of funds, purpose of the transaction, and your relationship with the receiver.

9. Use Restrictions and Account Suspension

You may not use our Services for illegal or speculative purposes, including exchange rate speculation. Transactions for unknown or third-party recipients are not permitted without our approval.

Currency Key may suspend or close your account for breach of these Terms, suspected fraudulent activity, or regulatory reasons. You may request closure of your account, but we must retain records as required by law.

10. Electronic Communications

You agree to receive all communications from Currency Key electronically, including these Terms, transaction records, and notifications. You must maintain a valid email address and notify us of any changes.

11. Service Interruptions

We will notify you of the major system maintenance (over 12 hours) that affects access to our platform. Delays may occur due to third-party service providers outside our control.

12. Disputes and Complaints

If you believe there has been an error in your transaction or you are dissatisfied with any aspect of our service, please notify us within one month of the transaction date.
